Prismy Terms of Service
Last updated: [DATE]
This is a translation. The French version prevails in case of discrepancy.
These terms govern the use of the Prismy Discord bot, its website and its management dashboard (together, "the Service"). By adding Prismy to a server or using the dashboard, you accept these terms.
1. Publisher
The Service is published by CAESAR, a private individual, on a non-professional basis. Contact: [TO COMPLETE: email address]. Full details are in the legal notice.
2. Description of the Service
Prismy is a Discord bot for server management, moderation and protection, with a web dashboard for configuration. Its features are described on the website and in the documentation. They may change, be added or be removed.
The protection modules (moderation, auto-moderation, anti-raid, verification) are free. An optional premium offer may be introduced; it will then be subject to additional terms.
3. Access
- Using the Service requires a Discord account and compliance with Discord's terms and policies, including the minimum age.
- Adding Prismy to a server and accessing its configuration are reserved for members with the required permissions on that server.
4. Administrators' responsibilities
Administrators of a server that uses Prismy:
- choose the enabled modules and their settings, and are responsible for these choices;
- inform their server's members that Prismy is present and which features are enabled, especially when message content is recorded in logs;
- use the information available to them (logs, sanction history, statistics) only to manage their server, in compliance with the law and members' privacy;
- are responsible for the content they configure (texts, images, welcome messages);
- are solely responsible for the giveaways they run with Prismy: description and delivery of prizes, compliance with the rules applicable to prize draws and with Discord's rules. Prismy only provides the drawing tool;
- inform members that tickets may be transcribed and sent to the staff.
5. Prohibited uses
It is prohibited to:
- use the Service for illegal activity, harassment, discrimination or any action contrary to Discord's rules;
- attempt to access a server's data without authorization, or to bypass the Service's protections or limits;
- attack, overload or disrupt the Service (mass requests, intrusion attempts);
- upload malicious files or content that infringes the rights of others;
- copy, resell or commercially exploit the Service without authorization.
Security vulnerabilities must be reported confidentially to [TO COMPLETE: reporting address], without being exploited.
6. Uploaded content
Administrators remain the owners of the content they upload (images, texts). They grant the publisher the right to store, process and display it solely to operate the Service. They warrant that they hold the necessary rights to this content.
7. Availability
The publisher makes its best efforts to keep the Service running, without guaranteeing permanent availability. The Service may be interrupted for maintenance, updates or external events (Discord or hosting provider outage, technical incident). The Service status can be checked on the status page.
8. Liability
- The Service is provided "as is". Moderation and protection tools reduce risks but cannot guarantee the complete absence of abuse, raids or detection errors.
- The publisher cannot be held liable for moderation decisions made by administrators or for the configuration they chose, nor for content posted by a server's members.
- Automatic restoration after an attack cannot recover deleted messages.
- To the extent permitted by law, the publisher's liability is limited to direct and proven damage.
9. Suspension and termination
- Any administrator can stop using Prismy at any time by removing it from their server. The server's data is then deleted after 30 days, in accordance with the privacy policy.
- The publisher may suspend or refuse access to the Service for a server or user who does not comply with these terms, particularly in the event of prohibited use or a risk to the Service's security.
10. Intellectual property
The Prismy name, its logo, its visual identity, the website, the dashboard and the Service's code are the property of the publisher. Any reproduction without authorization is prohibited. Third-party elements used (icons, fonts) remain the property of their authors and are used under their licenses, listed in the legal notice.
11. Personal data
The processing of personal data is described in the privacy policy.
12. Changes to the terms
These terms may be changed. In case of a significant change, administrators are notified on the official Discord server and in the dashboard. Continuing to use the Service after the new terms take effect constitutes acceptance.
13. Governing law
These terms are governed by French law. In case of dispute, an amicable solution will be sought first. The French version prevails in case of discrepancy with a translation.
